Haq mehr is a wife's legal right and a debt on the husband, not a favour — and it is not confined to what the nikahnama says. Two 2026 Lahore High Court decisions by Justice Sajid Mehmood Sethi, one reported by Dawn in May and one reported in October, show that a separate written marriage agreement can be enforced alongside the nikahnama, and that a wife's silence during the marriage does not mean she gave her dower up.
Most wives know the dower figure written in their nikahnama. Far fewer know that the nikahnama may not be the whole story. In 2026, the Lahore High Court twice dealt with promises made to a wife outside the nikahnama — and both times it treated her rights seriously. The lesson is simple: haq mehr is a legal right and a debt owed by the husband, not a favour — and a separate written agreement can add to it.
This is general information about the law and the reported cases, not advice for your particular situation.
Advocate Muhammad Iqbal Khan explains haq mehr beyond the nikahnama — why dower is a debt, not a favour, and what the 2026 rulings mean for separate agreements — in this video:
The October 2026 case: a fresh look at a separate agreement
The latest development was reported on 24 October 2026. Justice Sajid Mehmood Sethi, ruling on Shakeela Bibi's petition, dealt with a written agreement for separate accommodation, one tola of gold as dower, and Rs30,000 towards maternity expenses. She approached the court three years later, saying it had not been implemented; her husband argued the application was out of time.
The High Court found the family court and the sessions court had not fully examined the legal issues. It set aside both decisions and directed a fresh decision, in accordance with law, within 60 days — on whether the agreement was fulfilled and legally enforceable. Children's monthly maintenance, it added, must be considered separately from other marital rights.
Two cautions, stated plainly. This is a remand, not a final award — it grants no dower, house or maternity amount itself. And the report at publication gave no petition number or law-report citation, and the judgment was not located on the Lahore High Court website at the time of writing, so we invent none. Anyone relying on it in proceedings should obtain the certified record from the court.
The May 2026 case: a house promised outside the nikahnama
The principle is clearer in an earlier decision by the same judge, reported by Dawn on 31 May 2026. Justice Sethi dismissed Muhammad Khan's petition challenging family court and appellate decisions in Chiniot in favour of his former wife, Anwar Bibi. Case reference: 2026 LHC 3229 — Writ Petition No. 38628/2023, Muhammad Khan v. Anwar Bibi, Lahore High Court, decided 14 May 2026.
Her case: on their wedding day in 2017, her husband agreed in writing to give her a constructed five-marla house in Canada Colony, Chiniot, as dower, plus Rs300,000 if divorced. After the marriage ended in 2021 she claimed the house, its market value, iddat maintenance and the contractual amount. He denied the agreement, called it fabricated, said the property belonged to his first wife, and argued it was on ordinary rather than e-stamp paper — while the nikahnama showed dower of only Rs5,000.
The court rejected those arguments:
- The nikahnama is not the only record. Family courts have exclusive jurisdiction over dower disputes, and a separate written instrument can coexist with the nikahnama.
- Dower can be fixed or increased later. Under settled principles of Muslim law, it may be fixed before, at, or after marriage, and enhanced through a separate agreement.
- Silence during marriage is not surrender. Many women refrain from demanding dower during marriage for emotional, domestic and societal reasons, and such restraint cannot be held against them.
- Technical objections fail against proved rights. The stamp-paper objection failed once the transaction was independently proved, and both attesting witnesses stood firm in cross-examination.
- Refusing forensic examination hurts the denier. The husband's opposition to examination of his signatures and thumb impression eroded the credibility of his fabrication plea.
Finding no illegality, misreading of evidence or jurisdictional defect, the court dismissed the petition and maintained the decree awarding the house as dower.
What haq mehr actually is — and what it is not
- A debt, not a gift. An obligation the husband owes his wife. It can be prompt or deferred, and does not vanish merely because years passed without a demand.
- The wife's own property. Once fixed, it belongs to her — not to the family, and not to be absorbed into the household.
- It survives divorce. The right to recover dower remains enforceable after dissolution, in accordance with law, with related claims such as iddat maintenance where applicable.
- It is separate from other claims. Dower, dowry articles, children's maintenance and separate residence are distinct claims; settling one does not settle the others.
Your practical checklist
- Get any promise made at or after marriage in writing — a house, gold, cash, or a payment on divorce — and keep the original safe, with copies elsewhere.
- Sign before witnesses who can testify. In the Anwar Bibi case, the two attesting witnesses were decisive.
- If the other side denies a document, ask for forensic examination of signatures and thumb impressions. Refusal can count against the denier.
- Act promptly and keep proof of every demand. Limitation was argued in the October case and will be examined afresh, so delay helps no one.
- Keep claims distinct, and check any settlement or khula compromise for what it does to your dower before you sign a claim away.
Frequently asked questions
Is haq mehr limited to the amount written in the nikahnama?
No. As the Lahore High Court held in the May 2026 Anwar Bibi case, the nikahnama is not the exclusive record of dower. Dower may be fixed before, at, or after marriage, and enhanced by a separate written agreement.
I never demanded my dower during the marriage. Have I lost the right to claim it?
Not on that ground alone. The court observed that many women refrain from demanding dower during marriage for emotional, domestic and societal reasons, and such restraint cannot be read as giving the right up.
My husband says our separate agreement is fake, or that it was on ordinary stamp paper. Does that defeat my claim?
Not automatically. In Anwar Bibi the husband denied the agreement and objected to ordinary stamp paper, but both witnesses supported it, and his refusal of forensic examination justified an adverse inference against him.
What did the Lahore High Court actually decide in the October 2026 Shakeela Bibi case?
It did not finally award dower. As reported on 24 October 2026, the court set aside the lower decisions and directed a fresh decision within 60 days, with children's maintenance treated separately.

Common questions
No. As the Lahore High Court held in the May 2026 Anwar Bibi case reported by Dawn, the nikahnama is not the exclusive record of dower arrangements. Dower may be fixed before, at the time of, or even after marriage, and it may be enhanced through a separate written agreement.
Not on that ground alone. The court observed that many women refrain from demanding dower during the marriage for emotional, domestic and societal reasons, and that such restraint cannot be construed as giving up the right. The right to recover dower survives dissolution of marriage and remains enforceable in accordance with law.
Not automatically. In the Anwar Bibi case the husband denied the agreement and objected that it was on ordinary rather than e-stamp paper, but both attesting witnesses supported its execution and the husband had opposed forensic examination of his signatures and thumb impression, which justified an adverse inference against him. Technical objections about the form of documentation cannot defeat substantive matrimonial rights once the transaction is independently proved.
It did not finally award dower. As reported on 24 October 2026, the court set aside the family court and sessions court decisions and directed the family court to decide the wife's application afresh, in accordance with law, within 60 days — including whether the agreement was fulfilled and legally enforceable, and treating children's maintenance separately.
