Under Section 7 of the Muslim Family Laws Ordinance, 1961, no form of talaq becomes legally effective until 90 days after written notice reaches the Union Council Chairman — a rule the Supreme Court has confirmed applies to every form of talaq. This guide explains the notice, the Arbitration Council's reconciliation attempt, revocation within 90 days, and the effectiveness certificate you need before remarrying or updating NADRA records.
A husband pronounces talaq, and both families assume the marriage is over that very day. In Pakistani law, it is not. A talaq — in any form whatsoever — becomes legally effective only after a written notice to the Union Council Chairman and a 90-day waiting period under Section 7 of the Muslim Family Laws Ordinance, 1961. Until then, the marriage still subsists in law.
This guide explains the notice, the reconciliation attempt, revocation within 90 days, and the certificate you need before remarrying or updating official records.
Pronouncing talaq is only the first step
Section 7 applies to talaq "in any form whatsoever": a single pronouncement, a written divorce deed, talaq pronounced three times at once, and divorce exercised by the wife under delegated powers (talaq-e-tafweez). The Supreme Court has confirmed that the law makes no distinction between these forms for effectiveness — none takes legal effect until the 90-day period has expired.
The date on a private talaqnama is therefore not automatically the legal date of divorce. What counts is delivery of notice to the Chairman. Keep the notice and its delivery proof safe.
The Section 7 process, step by step
1. Written notice, as soon as may be. After pronouncing talaq, the husband must, as soon as may be, give the Chairman written notice and supply a copy to the wife. Failure is itself an offence, punishable with up to one year's simple imprisonment, a fine of up to Rs 5,000, or both.
2. Arbitration Council within 30 days. Within 30 days of receiving the notice, the Chairman constitutes an Arbitration Council to attempt reconciliation — a real step, not a formality to be skipped.
3. Ninety days before effectiveness. Unless revoked earlier, talaq is not effective until 90 days after notice is delivered to the Chairman. If the wife is pregnant at pronouncement, it is not effective until the later of the 90 days or the pregnancy ends.
4. Certificate of effectiveness. If reconciliation fails and the 90 days pass without revocation, the Council issues a certificate confirming the divorce's effectiveness and its effective date. That certificate is the proof that the marriage has legally ended.
The 90-day rule confirmed by the courts
The Supreme Court reaffirmed this when it upheld a wife's revocation of a divorce notice issued by her under delegated powers. A three-judge bench headed by Chief Justice Yahya Afridi dismissed the husband's appeal against two Karachi Union/Arbitration Council orders: the wife had issued the notice on 3 July 2023 and withdrew it on 10 August 2023, well within the timeline, and the chairman closed the proceedings the next day. The Court held that Section 7 applies to all forms of talaq, its effect is mandatory, and revocation during the reconciliation window is permitted.
The Lahore High Court agrees: during the 90 days a husband may revoke talaq expressly or by unequivocal conduct, and intimation to the Chairman is not a precondition for revocation. If revoked within the period, the marriage continues in law, whatever form the divorce took.
Can talaq be taken back during the 90 days?
Yes — that is what the waiting period is for. A talaq not yet effective can be revoked, expressly or otherwise, before the 90 days expire; if revoked, the divorce never takes effect. So neither party should rush into a new marriage or irreversible settlements during the wait: the legal position can still change.
One exception: a divorce by mubara'at (mutual divorce), once duly executed and communicated to the Chairman, is irrevocable, and the husband cannot withdraw from it unilaterally. Take advice before signing a mutual divorce deed, because it cannot simply be undone.
The effectiveness certificate — and why you need it
The certificate states the date the divorce legally took effect. It supports updating NADRA and CNIC records, proves a remarriage is lawful, and closes disputes about whether — and when — the marriage ended. Without it, a party claiming to be divorced may struggle to prove it, and a divorce whose notice was never properly served on the wife can be challenged. If either spouse is abroad, the same process applies: the notice goes to the Chairman for the area where the wife resides, so get advice early on attestation and on authorising a representative.
Your practical checklist
- Send notice promptly and keep proof: written notice to the Chairman, copy to the wife, by a method proving delivery — the 90 days run from delivery, not pronouncement.
- Record every date: pronouncement, notice, delivery, and the constitution of the Arbitration Council. The effective date depends on them.
- Attend reconciliation: do not ignore Council notices; what happens there decides whether the divorce proceeds or is revoked.
- Do not remarry during the 90 days: the marriage still subsists in law until the divorce becomes effective.
- Collect the certificate: after the 90 days, obtain the certificate and keep the original safe for NADRA, remarriage, and later disputes.
- To revoke, act inside the window: revocation must happen before the 90 days expire; after effectiveness, the position is different.
Frequently asked questions
Is my divorce effective on the day talaq is pronounced?
No. Under Section 7, talaq does not become effective until 90 days after written notice is delivered to the Chairman, unless revoked earlier. The pronouncement starts the process; the notice and waiting period complete it.
What if the husband never sends notice to the Union Council?
Then the statutory process is incomplete, and the divorce's effectiveness can be challenged. Sending notice is also a duty in itself — failure is punishable with up to one year's imprisonment, a fine of up to Rs 5,000, or both. Never rely on a private talaqnama alone.
Can talaq be withdrawn after it is pronounced?
Yes, within the 90-day window, expressly or by unequivocal conduct — the marriage then continues in law. A mutual divorce (mubara'at) duly executed and communicated is different: it is irrevocable.
Why do I need the certificate of effectiveness?
It is the official proof of the date the divorce legally took effect — needed to update NADRA/CNIC records, to remarry lawfully, and to settle any later dispute about whether and when the marriage ended.
